Thank you for using Wear it to Go and joining us in discovering great deals on clothing!
These Terms apply to (i) the Wear it to Go mobile application (“App”) and (ii) the Wear it to Go website (together, the “Platform”).
1. About Us and Acceptance
1.1 About Our Service
The Platform is operated by WEAR IT TO GO LTD (Company No. 16909508) of Unit 40 Silicon Business Centre, 28 Wadsworth Road, Perivale, Greenford, England, UB6 7JZ (“WITG”, “we”, “us”, “our”).
Wear it to Go is a mobile application that connects consumers with retailers offering special deals, discounts, and promotional offers on clothing and fashion products through curated “Surprise Bags”. Our mission is to help you discover and save on products from your favourite retailers across the UK and Europe while reducing fashion waste.
1.2 Your Agreement to These Terms
These Terms and Conditions (“Terms“) are a binding legal agreement between you (“you“, “your“, or “user“) and WEAR IT TO GO LTD that govern your use of the Wear it to Go mobile application and related services (collectively, “the Service“).
By creating an account, placing an order, or using the Platform, you accept these Terms without limitation or qualification. If you do not agree with these Terms, you must not use the Platform.
1.3 Age Requirement
You must be at least 18 years old and have legal capacity to enter into these Terms. By using the Platform, you confirm that you meet this requirement.
1.4 Privacy Policy and Data Protection
These Terms incorporate by reference our Privacy Policy and Cookie Policy (as updated from time to time). By accepting these Terms, you confirm that you have read and accepted our Privacy Policy. We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
2. What Wear it to Go Is (Marketplace + Sometimes Seller)
2.1 What We Provide
Wear it to Go is a platform that:
- Connects you with clothing retailers offering deals, discounts, and promotional offers through “Surprise Bags”
- Allows you to browse, search, and discover fashion deals near you
- Enables you to reserve and purchase items directly through the App
- Facilitates payment processing, customer support, and (in some cases) logistics
2.2 Marketplace Listings (Most Offers)
WITG is a marketplace platform connecting users with independent retailers (“Retailers”). Where an offer is sold by a Retailer, the contract for the goods is between you and the Retailer. We act as an intermediary platform connecting consumers with retailers.
2.3 WITG Store Listings (Some Offers)
Some offers may be sold by WITG directly (e.g., “WITG Store”). Where WITG is shown as the seller, the contract is between you and WITG. WITG Store offers may include recovered inventory from returns or failed collections that has been quality-checked and repackaged.
2.4 Service Availability
We strive to keep the Platform available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Technical issues or outages
- Circumstances beyond our control
3. Your Account
3.1 Creating an Account
To use most features of the Platform, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Keep your account information updated
- Maintain the security of your password
- Accept responsibility for all activities under your account
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You must:
- Not share your password with anyone
- Notify us immediately if you suspect unauthorised access to your account
- Log out of your account after each session on shared devices
We are not liable for any loss or damage arising from your failure to protect your account.
3.3 Account Termination
You may delete your account at any time through the App settings. We may suspend or terminate your account if:
- You breach these Terms
- We suspect fraudulent or illegal activity
- Your account has been inactive for an extended period
- We discontinue the Service
4. “Surprise Bags”, Condition, and Listings
4.1 Surprise Bags
Offers on WITG are sold as “Surprise Bags” (mystery bundles). You understand you will not know the exact items in advance. Deal availability, pricing, and collection times are set by sellers and may change at any time.
4.2 Discounted / Returns / Seconds / Damaged Stock
Items on WITG are marketed as discounted stock and may include customer returns, end-of-line, “seconds”, or items with minor cosmetic imperfections. The legal standard of “satisfactory quality” considers the description, price, and other relevant circumstances.
4.3 Minimum Description
The seller will provide a simple description (for example: quantity and category such as “1× trousers, 2× shirts”, and where applicable the intended gender category and size information).
4.4 Images Are Illustrative
Photos shown may be illustrative and may not show the exact item(s) you receive.
4.5 Hygiene / Restricted Items
Certain product categories (e.g., underwear, cosmetics) may have additional restrictions and may be non-returnable for hygiene reasons where permitted by law.
5. Orders, Payments, Fees, and VAT
5.1 Payment Processing
All orders are paid online via our payment provider (currently Stripe). By making a payment, you agree to Stripe’s terms of service. We do not store your full payment card details on our servers.
5.2 Platform/Service Fee
A platform/service fee may apply and will be shown clearly before you confirm payment.
5.3 VAT
Prices shown include applicable VAT unless stated otherwise.
5.4 Payment Split
Where the seller is a Retailer, you authorise WITG and/or its payment provider to process payment and allocate amounts between WITG and the Retailer in accordance with the commercial arrangements for the transaction.
6. Collection Types and Verification
6.1 Store Collection
You must collect within the collection window shown in the App. You may need to present an order confirmation and/or collection code. Treat retailer staff with respect when collecting your purchase.
6.2 Locker / Pickup Collection
Some orders may be collected from a locker or pickup location. Depending on the offer, locker/pickup logistics may be operated by (a) the Retailer, or (b) WITG (including WITG-managed fulfilment).
6.3 Uncollected Orders
If you do not collect within the stated time window (or carrier hold time for lockers/pickups), the order may be treated as uncollected and handled under Section 7.
7. Cancellations, No-Shows, Refunds, and WITG Credit
This section sets out our standard platform rules, while confirming that statutory rights are not affected. UK online cancellation rules and refund obligations are explained in government guidance.
7.1 Customer Cancellation (Standard Rule)
- You may cancel an order up to 2 hours before the start of the stated collection window (or dispatch cut-off where applicable).
- After that cut-off, cancellation may be unavailable because fulfilment has started and stock has been committed.
7.2 No-Show / Uncollected (Standard Rule)
- If you do not collect your order within the collection window (or applicable locker/pickup hold time), the order may be treated as forfeited and no refund will be issued as a standard rule.
- WITG Credit: In uncollected/failed-collection cases, you may receive WITG Credit (in-app voucher) instead of a cash refund. This credit can be used on future purchases within the App.
7.3 No Discretionary Refunds (Standard Rule)
- As a general policy, WITG does not offer discretionary “change of mind” refunds.
- Exception (goodwill): In exceptional circumstances, we may offer WITG App Credit at our discretion.
7.4 Statutory Rights Are Not Affected (Important)
Nothing in these Terms limits your rights under the Consumer Rights Act 2015 (for faulty / misdescribed goods) or the Consumer Contracts Regulations (which may apply to online purchases). Where you have a legal right to a refund, we will process it in accordance with the law and applicable guidance.
7.5 Faulty / Not as Described
If goods are faulty, not as described, or not fit for purpose, you may be entitled to remedies against the seller under the Consumer Rights Act 2015 (including the “short-term right to reject” in relevant cases).
8. Returns (Where Accepted)
8.1 Return Instructions
Where a return is accepted or required by law, return instructions will be provided in-app (including the return address and deadline).
8.2 Centralised Returns
Unless we tell you otherwise, do not return items to a Retailer store or staff; follow the return instructions provided by WITG Support. Returns should be sent to the WITG returns address provided.
8.3 Return Costs
If an item is returned due to a fault/misdescription, the seller may be responsible for reasonable return costs where applicable.
8.4 WITG Credit on Returns
Where a return is accepted, you may receive WITG Credit (in-app voucher) for use on future purchases. Cash refunds will be provided where required by law.
8.5 Recovered Inventory
Returned items may be quality-checked, repackaged, and resold via the WITG Store within the App.
9. Retailer Obligations (Retailer Terms Summary)
Retailers using the Wear it to Go platform agree to comply with the full Retailer Terms & Conditions (available separately). Key obligations include:
9.1 Offer Accuracy & Compliance
- Provide accurate offer descriptions (including basic bag composition, category, size information)
- Ensure all listed items comply with applicable laws (product safety, labelling, trading standards)
- Comply with applicable consumer protection laws and provide statutory remedies where required
9.2 Order Fulfilment
- Honour confirmed orders within the stated collection window
- Maintain adequate stock to fulfil published offers
- Verify collection codes accurately before releasing goods
9.3 Quality Standards
- Items must meet the “satisfactory quality” standard appropriate for discounted/surplus stock
- Items with defects beyond normal surplus stock (e.g., significant damage) must be clearly disclosed or excluded
9.4 Returns Handling
- Centralised Returns: Retailers agree that customer returns are processed through WITG (not returned directly to the Retailer’s store)
- Retailers retain their revenue share (e.g., 85%) on returned orders — WITG absorbs the returns handling burden
- Retailers must not instruct customers to return items directly to their stores
9.5 Platform Fees & Payments
Platform fees vary by retailer model:
- Physical Store: 15% platform fee (retailer receives 85%)
- Online Self-Managed: 15% platform fee (retailer receives 85%)
- WITG Managed: 35% platform fee (retailer receives 65%)
- Annual membership fee: £39 per year (or promotional voucher code)
- Payments processed via Stripe Connect; payouts as per configured schedule (weekly, monthly, or annual)
9.6 Prohibited Conduct
Retailers must not:
- List counterfeit, stolen, or illegal goods
- Misrepresent item condition, value, or composition
- Fail to honour confirmed orders without valid reason
- Direct customers away from the WITG platform for payment
- Abuse the platform, commit fraud, or violate these Terms
9.7 Suspension & Termination
WITG may suspend or terminate Retailer accounts for:
- Repeated order fulfilment failures
- Consumer complaints or regulatory concerns
- Breach of these Terms or applicable law
- Non-payment of platform fees
10. User Responsibilities and Conduct
10.1 Acceptable Use
When using Wear it to Go, you agree to:
- Use the Platform only for personal, non-commercial purposes
- Treat retailers, their staff, and other users with respect
- Provide accurate information when creating reviews or feedback
- Only reserve deals you genuinely intend to collect
- Comply with all applicable laws and regulations
10.2 Prohibited Activities
You must not:
- Use the Platform for any illegal or unauthorised purpose
- Use automated systems, bots, or scripts to scrape data from the Platform
- Attempt to gain unauthorised access to our systems or other users’ accounts
- Reverse engineer, decompile, or attempt to extract source code from the App
- Use the Platform to harass, abuse, or harm others
- Submit false, misleading, or fraudulent information
- Create fake reviews or manipulate ratings
- Resell, redistribute, or commercialise deals without retailer permission
- Interfere with the proper functioning of the Platform
- Upload or transmit viruses, malware, or harmful code
10.3 Consequences of Violation
If you violate these Terms, we may:
- Suspend or terminate your account immediately
- Remove any content you have posted
- Report illegal activity to law enforcement
- Take legal action to recover damages
- Permanently ban you from creating new accounts
11. Reviews and User Content
11.1 Submitting Reviews
You may have the opportunity to review retailers and deals. By submitting a review, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, display, and distribute your review on the Platform and in our marketing materials.
11.2 Review Standards
All reviews must:
- Be based on your genuine experience
- Be accurate and truthful
- Not contain offensive, discriminatory, or defamatory language
- Not include personal information about others
- Comply with applicable laws and regulations
11.3 Review Moderation
We reserve the right to remove any reviews that violate these standards or that we deem inappropriate. We do not verify the accuracy of user reviews.
12. Intellectual Property
12.1 Our Rights
All content on the Wear it to Go Platform, including but not limited to software and source code, graphics, logos, design elements, text, images, trademarks, and user interface, is owned by or licensed to WEAR IT TO GO LTD and is protected by UK and international intellectual property laws.
12.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from the Platform without our prior written consent.
12.3 Feedback and Suggestions
If you provide us with ideas, suggestions, or feedback about the Platform (“Feedback“), you grant us the right to use that Feedback without any obligation to compensate you.
13. Disclaimers and Limitations of Liability
13.1 Service Provided “As Is”
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13.2 Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for any loss or damage arising from retailers’ products or services
13.3 Retailer Responsibility
Where the seller is a Retailer, the Retailer is solely responsible for:
- The quality and safety of their products
- Accuracy of deal descriptions and availability
- Compliance with consumer protection laws
- Fulfilling orders and handling statutory remedies
13.4 Non-Excludable Liability
Nothing excludes liability that cannot be excluded by law (including fraud, death/personal injury caused by negligence).
14. Indemnification
You agree to indemnify and hold harmless WEAR IT TO GO LTD, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Platform
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by:
- Posting the updated Terms on this page with a new “Effective Date”
- Sending you an email or in-app notification for material changes
Your continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
16. Governing Law and Disputes
16.1 Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, subject to any mandatory consumer protections.
16.2 Dispute Resolution
If you have a dispute with us:

- We will try to resolve the dispute informally within 30 days
- If unresolved, you may use an Alternative Dispute Resolution (ADR) service
16.3 Your Legal Rights
Nothing in these Terms affects your statutory rights as a consumer under UK law.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
17.4 Assignment
You may not assign, transfer, or delegate these Terms without our prior written consent. We may assign these Terms at any time without notice.
